These Terms of Use govern, together with the Privacy Policy, your use of the mobile applications (the ”Application”) and related services provided by Fiodar Puchkoucki (”Us”, ”We”).
By downloading the Application you agree to be bound by these Terms of Use and by continue using, you confirm and affirm that you have read, understood and agree to these Terms of Use. If you do not agree to these Terms of Use, do not use the Application.

Disclaimer of Warranty
The Application and all of its content is provided on an ”As Is” and ”As available” basis and We do not provide any assurances of the availability or usability by you of the Application.

Limitation of Liability
We shall not be liable for any errors in any content or for any actions taken in reliance thereon. Furthermore, we shall not be liable to you for any interception of online communications, software or hardware problems (including, without limitation, viruses, loss of data or compatibility conflicts).

Subscription
Our apps have an optional Premium subscription.

The purchase will be charged to your iTunes account. Once you're a subscriber, you can manage your subscription from iTunes or on your iOS unit after purchasing it, and you'll also be able to cancel the auto-renewing subscription from there. Deleting the app does not cancel the subscription. You can, however, cancel a subscription even after you've deleted the app. The subscription will auto-renew 24 hours before the subscription period ends, with the same kind of subscription you already bought, to the same price.
You may at any time terminate your membership, in which case your membership will still be valid for the subscription time you have already paid for. Our auto renewable In-app purchase subscriptions can only be cancelled using the App Store cancelation service. If you would like to contact Apple, please use this link https://support.apple.com/en-us/HT202039. Subscription fees can be found in the mobile applications. We reserve the right to change the subscription fees from time to time.

Ownership and Rights to Created Music

The User acknowledges and agrees that the Created Music is the result of the User’s interaction with the App and does not grant the User any ownership rights, intellectual property rights, or any other proprietary rights over the Created Music.

Users have no rights to use the Created Music for commercial purposes, including but not limited to selling, licensing, distributing, or otherwise exploiting the Created Music for financial gain or any business-related activity.

The User may use the Created Music solely for personal, non-commercial purposes, including private listening, sharing with friends, or other similar uses that do not involve any commercial benefit.

No Commercial Use

The User agrees that they will not use the Created Music for any commercial purposes, including but not limited to the sale, resale, licensing, or any other form of exploitation for monetary gain. The App is intended for personal use only, and any commercial use of the Created Music is strictly prohibited.

Creator's Rights to the App

The creator of the App ("the Creator") does not claim ownership over any Created Music produced by Users. The Creator has no rights, title, or interest in the Created Music and does not assert any intellectual property rights or claim any form of ownership in the content produced by Users.

The Creator is not responsible for any use of the Created Music by the User outside of the App, including any infringement of third-party rights or violations of the Terms of Use by the User.

Disclaimer of Liability

The App and its services are provided "as is" without any warranties or representations of any kind, either express or implied. The Creator disclaims any liability arising from the use of the App or the Created Music, including but not limited to any damages resulting from the User's violation of these Terms of Use.

We would like to explain the reason for such terms of use. The fact is that music and songs are created by artificial intelligence. This means that music can be very similar to existing ones (which may have a copyright holder). In this case, there may be a conflict of interest (between users, us and the copyright holder) and all the problems that follow from this.
Therefore, in this way we protect ourselves and our users from problems, claims and litigation.

We also advise you to be careful and wary of music generators that claim to give you unlimited rights to songs. (Perhaps in the event of a claim from the copyright holder, you will be left alone with your problem)

Modification of Terms

The Creator reserves the right to amend, modify, or update these Terms of Use at any time without notice. Users are encouraged to review these Terms of Use regularly to remain informed of any changes.

By using the App, the User acknowledges that they have read, understood, and agree to these Terms of Use. If you do not agree to these Terms of Use, you must cease using the App.
